With the amendment of BOOK XX dated 21 March 2021, a new insolvency procedure was created, i.e. the preparatory agreement JRP.
Article XX.39/1 states:
"At the unilateral request of the debtor, the President of the Commercial Tribunal may appoint a court-appointed administrator, with the aim of obtaining an amicable settlement within the meaning of Article XX.64 or drawing up a restructuring plan as provided for in Article XX.67."
This new insolvency procedure was incorporated into RegSol with release 01/06/2021. The debtor (or his/her lawyer) can submit a request preparatory agreement JRP Art.XX.39/1 through RegSol PUBLIC, after which the file is handled in RegSol PRIVATE by the court registry, and after their appointment, by the delegated judge and the court-appointed administrator.
