Working in RegSol

The login page www.regsol.be has been changed due to the launch of the Central Register for Collective Debt Settlement (JustRestart) in spring 2023. 

Naturally, the later launch of JustRestart will not mean any changes for you. We have shared this information purely to keep you up to date with the developments  
 

Go through the requested steps and save if you do not have all the information at hand. You will find your provisional file later under ‘my files’ in the form of a ‘draft’.  You can open the draft and continue working until you wish to save it again or until you can submit the file.

It is only after you have filled in all the mandatory fields of all steps that you can effectively submit your bankruptcy declaration.

When you submit a new file (a bankruptcy declaration or a JRP request), certain steps require you to add documents.

If you upload an incorrect document as part of one of these steps and you wish to delete this, you can do so as follows: 

  • you can upload a new document as part of the step in question, which will then replace the incorrect document  
  • you can proceed to the next steps and then return — a bin icon you can click to delete documents from the step in question will be displayed next to all documents you have uploaded
  • you can ‘provisionally save’ the file. When you reopen the file via “My files”, the bin icon will be displayed next to every document you have uploaded.
     

Please note: once you have submitted your file, you will no longer be able to delete the documents you have uploaded. 

If you are a creditor or debtor and you have a legal counsel who has access to your file or debt claim, you will see exactly the same documents as your legal counsel.

You can also add documents to a bankruptcy file yourself, although the actions you can take are limited. In judicial reorganisation proceedings, you cannot add documents yourself if your file is managed by an attorney.
Would you like to appoint another solicitor or manage your file or debt claim yourself?

In the event of judicial reorganisation proceedings:

  • Either your first solicitor can add you as debtor because you want to follow up the file yourself; then you can remove the solicitor and/or add a new solicitor.
  • Or a new solicitor can request access to the file: the delegated judge can grant the access and cancel the access of the first solicitor.
     

In case of bankruptcy:

  • Either a new solicitor requests access to the file: the examining magistrate can approve this application for access and cancel the access for the first solicitor.
  • In other words, if you wish to follow up your file or debt claims yourself, you can request access from the examining magistrate yourself.

Definition of Book XX: Any company whereby its activity consists primarily of providing, independently and under its own responsibility, intellectual services which require prior and continuous training and are subject to a doctrine of obligations which can be enforced by law or by virtue of a disciplinary body designated by law.

If the liberal profession in question meets this definition, it is included in the list that appears in the declaration form.

This list currently includes the following professions:

In accordance with the provisions in BOOK XX, the court will decide when an insolvency official, specifically in the context of this liberal profession, must be (co-)appointed.

The liberal professions that are NOT included in this list, which appears in the declaration form, are subject to the general provisions of the Insolvency Statute.

Before filing a JRP petition, you must first pay the contribution required by law for the Second Line Legal Aid. This fee is regularly indexed. You can find the actual amount here. When submitting the petition, you will automatically be informed of the bank account to which payment must be made. 
 
Only when the contribution has actually been received by the court will the petition be registered. 
 
For very urgent matters please contact the registrar to pay this contribution, possibly in cash, at the court registry.

General

What is the Central Register of Solvency?

The Central Register of Solvency is a digital platform for insolvency files.  
Courts (judges, examining magistrates, delegated judges, and registrars), curators, debtors and creditors can create, store, sign and exchange the most important documents of an insolvency file online.

The Central Register of Solvency, RegSol, is managed by the Communal Bar Association of Belgium, namely the Orde van Vlaamse Balies (OVB) and l’Ordre des Barreaux Francophones et Germanophone (OBFG).

Use of the Register presupposes acceptance of the terms of usage.You can find the terms of usage by clicking on ‘terms of usage’ at the bottom right of the homepage or here.

The Register is an authentic source of data. The Register:

  • Digitises the paper insolvency files that have been submitted to the corporate courts.
  • Digitises the declarations of bankruptcy, the requests for judicial reorganisation proceedings, and the debt claims submissions. Allows amicable settlements concluded outside the judicial reorganisation proceedings to be uploaded.
  • Facilitates communication between all actors in the insolvency file.
  • Provides access to the insolvency file, as provided for by law, to all possible parties involved in the insolvency proceedings.

 

RegSol consists of two separate sections:

  1. The private section (www.private.regsol.be), in which the files are managed and in which judges, examining magistrates, delegated judges, registrars, and curators perform their duties.

     
  2. The public section (www.regsol.be), in which:
  • debtors or their attorneys can submit their declarations of bankruptcy or requests for judicial reorganisation proceedings;
  • creditors can submit and follow up on their debt claims;
  • all parties concerned may request access to an insolvency file;
  • amicable settlements outside the judicial reorganisation proceedings can be uploaded.

By deploying user groups and steering committees, the DPA-RegSol administrators have a perfect feel for the needs of all these users and the functionalities of the Register are regularly improved and expanded.

Bankruptcy Law of 1 December 2016 and Book XX Insolvency of Enterprises (Law of 11 August 2017)

Pursuant to the Law of 1 December 2016, the existing Belgian insolvency legislation was amended and since then, the settlement of the bankruptcy file has taken place electronically via DPA-RegSol.

Pursuant to the Law of 11 August 2017, with the introduction of Book XX in the Economic Law Code (WER), the Register was further expanded as from 1 May 2018 and the following functions were included:

  • the digital submitting of the bankruptcy declaration and the complete legal settlement of the bankruptcy;
  • the digital submitting of the amicable settlement concluded between a number of parties, outside the court and any proceedings;
  • the digital request for judicial reorganisation proceedings (amicable settlement, collective agreement, or transfer) and the complete procedural settlement.

Notifications

Notifications are automatic notifications sent by DPA-RegSol when a certain action has been completed in the program. The law provides that you must be informed of certain actions: the notifications are the result of this obligation and remain attached to the file, so that you (and possibly all other users within your group) can always consult them.

Notifications are visible to all members of your group. You can find them on your RegSol dashboard or in the detailed file view.

Language
The notifications will be made in the language you have selected in the lower left-hand corner of your browser.  You will receive the notification emails in the language you have specified.
 
To change the preferred language of the mails, proceed as follows:

  • Log on to www.regsol.be.
  • Click your mail address in the upper right-hand corner and then click ‘User administration’.
  • Click the ‘Edit’ button in the ‘Personal data’ section. 
  • Change the language in which you wish to receive mails below

     

Messages

Messages are messages that were posted by another actor active in a file in RegSol. Its content can be freely determined by the originator of the message. 

Messages are only visible to the person who is designated as the contact in a group. 
If you are the contact person for the group, you can consult the messages addressed to you at any time on your RegSol dashboard or in the ‘Messages’ tab of the file. 

If you are not the default contact person for the account group, you (like the other members of your account group) can always send messages yourself, and consult your sent messages under the ‘Messages’ tab on the dashboard or in the file.
Messages can never contain attachments.

If you, as a contact person, choose to receive an email to report a new message, this email will arrive in your inbox. 

Language
The messages sent from the court are drafted in the language of the judicial procedure. 
Therefore, you cannot determine the language of the messages sent by a legal actor (the trustee, the delegated judge, the registrar, etc.).

 

Emails

If you are the contact person of the account group, you can decide whether you want to receive an email to inform you of the receipt of a ‘message’ or a ‘notification’.

To do this, click the triangle in the upper right-hand corner, next to your email address, to find the ‘user management’ button; under the ‘personal data’ button, you can choose whether or not you want to receive an email if a message or notification appears for you within regsol.be. A green check mark means that you wish to receive an email. If you do not wish to do so, click ‘Edit’ and uncheck what you no longer wish to receive by email.

If you are not a contact person, you can choose whether or not to receive emails notifying you of a new ‘notification’. You will not receive any mails to report a new ‘message’; these mails will only go to the account group’s contact person.

Language
The emails can be written in the language of your choice. To make this selection, proceed as follows:

  • Log on to www.regsol.be.
  • Click your mail address in the upper right-hand corner and then click ‘User administration’.
  • Click the ‘Edit’ button in the ‘Personal data’ section.
  • Change the language in which you wish to receive mails below

 

Finding a file in RegSol.be, submitting a debt claim, or submitting a declaration of bankruptcy is free of charge. The follow-up of the files in which you are involved, either as a creditor or as a third-party stakeholder, is also free of charge.

You must pay for the request for judicial reorganisation proceedings. The legislator has determined that you have to pay a fee to the DPA-RegSol administrator. This fee has been laid down in a Royal Decree and is currently at €298. Once you have completed the application form and uploaded all the necessary documents, you will be redirected to a payment page. Your application can only be processed after you have made the payment.

You should bear in mind that you will also have to pay a court fee afterwards, which amounts to €20.00.  When you confirm your submission, you will see the account number of the clerk of the court’s office to which it must be deposited.

From the moment you wish to deposit an amicable settlement outside any insolvency proceedings in DPA-RegSol, a remuneration, also called a fee, of €298 for the first two years and every year thereafter, is also due to cover the administrative costs

A fee may also be requested for submitting a debt claim: the fee initially amounted to €6 as from 01/04/2017. As from 6 December 2018, this fee was reduced to 0.

The fee is not subject to VAT. You will only receive a receipt for payment, not an invoice.
 

For Lawyers

To link your new lawyer’s card to your profile on regsol.be, you must first log in using your email address and password.  
 
Once logged in, click on your email address in the upper right corner and go to ‘User management’.

 On the page with your user data, press the ‘Change’ button in the ‘Personal information’ box.

Then insert your new lawyer’s card into your card reader and press ‘read lawyer’s card number’.

You will be redirected to the ZETES environment where you can enter the PIN of your new card (4 digits).
 
The number that appears in the box now corresponds to the number on the back of your lawyer’s card.
 
After logging out, you will be able to log in securely with your new lawyer’s card.


 

Request preparatory agreement JRP

With the amendment of BOOK XX dated 21 March 2021, a new insolvency procedure was created, i.e. the preparatory agreement JRP.

Article XX.39/1 states:
"At the unilateral request of the debtor, the President of the Commercial Tribunal may appoint a court-appointed administrator, with the aim of obtaining an amicable settlement within the meaning of Article XX.64 or drawing up a restructuring plan as provided for in Article XX.67."

This new insolvency procedure was incorporated into RegSol with release 01/06/2021. The debtor (or his/her lawyer) can submit a request preparatory agreement JRP Art.XX.39/1 through RegSol PUBLIC, after which the file is handled in RegSol PRIVATE by the court registry, and after their appointment, by the delegated judge and the court-appointed administrator. 
 

On regsol.be you can submit a request preparatory agreement JRP in accordance with Article XX.39/1: after logging in, you will go to the homepage. Go to the bottom left-hand corner of the page to “Judicial reorganisation proceeding” and click on “Submit request preparatory agreement JRP Art.XX.39/1.”  

If you do not yet have an account on regsol.be, you must first create one following the instructions you will find on the right-hand side of the home page, under the heading “Create an account”.
 

When submitting your request preparatory agreement JRP according to Article XX.39/1, you will be required to include the following documents:

 

  • a document demonstrating that the continuity of the business is or will be under threat (within the meaning of Article XX.45).
  • an account of the events.
  • an electronic address.
  • the recent annual accounts or personal income tax returns and the annual accounts of the last financial year that have not yet been filed.

 

As with the filing for a Judicial Reorganisation Proceeding (JRP) application, a fee is payable when filing a request preparatory agreement JRP according to Article XX.39/1. The debtor, or his/her lawyer, pays this fee when filing the application. 

A contribution for the LEGAL AID FUND is also due (you can find the actual amount here): this is paid by the debtor directly to the court (as in the case of filing a JRP application). He/she will receive the necessary instructions for this when filing his/her application in RegSol.

This fee is regularly indexed. When submitting the petition, you will automatically be informed of the bank account to which payment must be made. 

No, to ensure the confidentiality of the request preparatory agreement JRP, they cannot be looked up in regsol.be. Only the applicant (and possibly his/her lawyer) and third parties invited by the court-appointed administrator may consult these files.

If, as a debtor, you have filed a request preparatory agreement JRP yourself, you can immediately access your file in regsol.be, under the “My files” tab. In your capacity as debtor, you can also give your lawyer access. 

Should you wish to grant access to someone else, you should contact the court-appointed administrator. This is the only party who can invite someone to access a file. 

The request preparatory agreement JRP are not visible in regsol.be to others.
 

You will find the application in regsol.be under the “My files” tab.

Access to or inspection of files

Anyone can request access to an open file. You can search for the file in question by clicking on ‘request access to an open file’ on the homepage. Your access application will be reviewed by:

  • The curator – for bankruptcies occurring before 1 May 2018
  • The examining magistrate – for bankruptcies occurring after 1 May 2018
  • The delegated judge – for judicial reorganisation proceedings when the request for access is made by a party other than a creditor
  • The debtor (or his counsel) - for the judicial reorganisation procedures, when the request for access is made by a creditor
  • The debtor in the judicial reorganisation procedure or undergoing bankruptcy, and this only and when:
    • the request for access is made by the counsel for the debtor and the debtor is effectively linked to the file in question.
    • If a debtor is not linked to the file, the requests for access submitted by the debtor’s counsel will be handled by one of the following (see also above):
      • Delegated judge (judicial reorganisation proceedings)
      • Examining magistrate (bankruptcies with a judgement date after 1 May 2018)
      • Trustee (bankruptcies with a judgement date before 1 May 2018)
         

You will receive an email and a notification as soon as your access has been granted. If access is refused, you will also be informed of the reason in the notification and email. If you have access to a file and the file is closed, this access remains in the RegSol archive.


If you do not yet have access to a file that has been closed in the meantime, the question will be submitted to the clerk’s office of the Corporate Court concerned, which can then grant you access by inviting you to take a look at a closed file in the archive.

Through DPA-RegSol, you can look up all outstanding bankruptcies and judicial reorganisation proceedings, ask for access to them, or submit a debt claim for them.

If you, as debtor, creditor, third party, or attorney of one of these, had access to a file that has been archived in the meantime, you will continue to have access to the file even after the file has been archived.

If you do not yet have access to a file that has been closed in the meantime, the question will be submitted to the clerk’s office of the Corporate Court concerned, which can then grant you access by inviting you to take a look at a closed file in the archive.

You can change your personal information by clicking on your email address at the top of your account.  Then click on ‘User management’.

If different people or different departments of your organisation work in regsol.be, you can organise your organisation's account in groups. Users assigned to the same group can see each other's files and thus follow up on them.  

If you wish to set up such a structure, you will need an account administrator (at least 1) and appoint one group administrator for each group. The person (i.e. the e-mail address) who creates the account in regsol.be also becomes the account administrator by default. (stond oorspronkelijk wat verder in de FAQ)

More specifically, you can create the following levels:

  • One account administrator (or several)
  • One group administrator (or several)
  • Users
     

To have several people from your organisation work in the same account, proceed as follows: 

First add the persons to your account

  • Go to the "users" tab and add the details of the person to be added.  
     

Appoint the account administrator(s)

The person (i.e. the e-mail address) who creates the account in regsol.be also becomes the account administrator by default.
Only an account administrator can add or remove another account administrator.

To add or remove an account administrator:

  • Go to "User management".
  • On the right you will see an "Account administrator" box. You can add an account administrator in this box. 
  • If you press the button, all the added users in your account will appear in your account. An account administrator can be chosen there.   
  • You can remove an account administrator in the same box by clicking the trash icon. 


Add a group (or multiple groups) to your account

  • Click the "Groups" tab. 
  • Enter the required data.  
  • The "actions" button allows you to "edit" the existing group, add users to the group and assign different rights. 

Important: only an account administrator can create new groups.


Add the user to a group

Once a user is added as a user in your account, he can also be assigned to a group.
A user can be part of different groups.

Important: only an account administrator can add new users by creating and then adding them to the group, but the group administrator can add existing users to his group. 

  • Go to the "Groups" tab, choose "Actions" and add a user created in your account. 
  • You can also remove a user from the group in the same box by clicking the trash icon.


Determine which rights the group is entitled to
Click the "Groups" button and choose the "Actions" button.
In the column of your group under "rights" you can change the following rights:

  • Button 1: preparing a debt claim or filing a debt claim
  • Button 2: filing a new insolvency procedure (a declaration of bankruptcy or a petition for judicial reorganisation proceedings)
  • Button 3: here the account administrator also indicates whether it is a normal user (red) or a group admin (green)
     

You will no longer be able to view a file via the public section if you did not have access to that file before it was closed.

If you do wish to access a closed file, please contact the clerk at the Corporate Court in question by e-mail. Contact details for the (insolvency) clerk’s offices can be found on the Courts and Tribunals website https://www.rechtbanken-tribunaux.be/nl or https://www.rechtbanken-tribunaux.be/fr. The clerk can grant access by inviting you to view the file. 

To assess your request, the clerk will need the following information from you:

  • surname
  • first name
  • national registry number 
  • address 
  • e-mail address 
  • company name (if applicable)
  • any differing trading names (if applicable)
  • company legal form (if applicable)
  • company number (if applicable)
  • company address (if applicable)
     

As such, please make sure you include this information in your e-mail to the clerk’s office. 
Once the clerk has invited you to view a file, you will receive an e-mail to let you know. Once you have registered for and/or logged in to regsol.be, you can find the closed file under the “My files” tab.

If you did have access to a file before it was closed, this file will remain accessible to you even after it has been closed. You can view the file in question in “My files”.

Please note: to be able to view a closed file, ‘Include closed files in search’ must be ticked.

Depending on the role you have in a file, you will or will not be able to give people access to one of your files. If, for example, you are a debtor, you will be able to give access to one or more of your attorneys.

  • First find the file you want to give access to. To do so, click on the ‘MY FILES’ tab.
  • Click on the file you want to give access to in the list.
  • Click on the ‘DEBTOR/ATTORNEY’ tab.
  • Click on the ‘Add debtor/lawyer’ option.
  •  A pop-up will appear. Fill in all required fields and then click on ‘add’.

Notifications

Notifications in RegSol are communications intended for you, as a regsol.be user linked to one or more files in RegSol. These notifications are sent automatically by RegSol when certain conditions are fulfilled. No other users are involved in sending notifications. 

Notifications are visible to all members of your group. You can find them on your RegSol dashboard or in the detailed file view

 

Messages

A message is a communication posted by another actor in a RegSol file and intended for you.  Messages in RegSol never include any attachments.

Messages are only visible to the person who is designated as the contact in a group. If you are the sole user in your group, you will automatically be designated as the contact, meaning you will be able to view any messages. You can find your messages on your RegSol dashboard or in the detailed file view.

 

E-mail

In the user management view, you can indicate which e-mails you wish to receive from RegSol. Click your name in the top right of the screen, then “User management”, then the blue “Change” button next to your personal details. This will allow you to select whether you wish to receive e-mails letting you know about notifications, messages or any changes to your user rights. 

If you have ticked the option in the user management view to receive an e-mail to let you know you have received a message, RegSol will send you an e-mail to let you know you have received a message. The e-mail will contain the outline of the message, but the exact details will be omitted for security reasons.

If you have ticked the option in the user management view to receive an e-mail containing your daily notifications, you will receive an e-mail overview once a day of all notifications and personal messages received in your file that day. This e-mail will not be sent after every notification; instead, it will only be sent once every day. 

Sending a message

All regsol.be users who have access to a file can send a message via the file. 
Messages in regsol.be can be sent to

  • The curator
  • The examining magistrate
  • The court clerk 
  • The delegated judge (for JRP)
  • The debtor or the debtor’s attorney (for GRP only)
  • The court officer (for JRP)
  • The provisional administrator (for JRP)
  • etc.
     

If you would like to save a message to send it at a later date, click “Save”. You will be able to find the saved message under the “Drafts” tab, from where you can edit and send it at any time.

 

Receiving a message

If someone has sent you a message, you will be able to see it under the “Messages” tab on your dashboard, and under the “Messages”/“Inbox” tab in the file in question.


Please note that you will only receive messages if you have been designated as the contact for the group you are part of. If you are the sole member of your regsol.be group/account, you will automatically be designated as the contact, meaning you will always receive any messages sent to you (or to your account).

If you would like to receive an e-mail letting you know you have received a message in regsol.be, click your name in the top right of the screen, then “User management”, then the blue “Change” button next to your personal details. This will allow you to tick whether you wish to receive e-mails letting you know about messages and/or notifications.
 

If you wish to upload multiple documents under a single element while using regsol.be to submit:

  • a bankruptcy declaration
  • a JRP request
     

you can select more than one document at the same time by using the Ctrl key on your keyboard.

Please note that if you add one document after the other, the previous document you uploaded will be replaced every time.

The maximum size is 15 MB per file. A PDF file that is too big to upload can easily be made smaller by splitting it.  You will receive an error message if your file is too big. 


Splitting a file
To split pdf documents, we advise you to contact your IT department.  If you do not have an IT department, you can also install software yourself. We strongly discourage the use of an online web service because of the sensitivity of the information.

There can be several reasons for this: 

  • In a bankruptcy, items are only visible in the timeline after the registry has processed them.
  • In a JRP, items are only visible after the initiating party passes the item on to a following party or sets it to OK.
  • You do not have reading rights to the item in the timeline

Create an account

To access www.regsol.be you must first create an account.
You do this by clicking "Create an account" on the Homepage. 
Enter your details to register.  
You will receive a confirmation e-mail to activate your account.  

What is CSAM?

CSAM is the gateway to a whole host of public services. Whenever you log in to CSAM, you will be taken to a confidential and reliable environment. As CSAM ensures that everyone follows the same rules and uses generic services, the system guarantees a high and constant level of security. 

  • Logging in to RegSol using CSAM = strong authentication.
  • Logging in to RegSol without using CSAM = weak authentication.

Attorneys accessing regsol.be using their attorney card will also be using strong authentication.

You will be unable to perform certain actions. If you log in using weak authentication, the buttons for the actions you are unable to perform will be coloured grey instead of blue.

 

Strong authentication: how do I log in and what can I do?

How do I log in?

  • You can log in using your eID, Itsme or your attorney card once your national register number or attorney card number has been added to your account via one-off strong authentication.

IMPORTANT

To be able to log in using strong authentication, your national register number or attorney card number (if you wish to log in using your attorney card number) must have been added through your account via strong authentication. 


What is the one-off process to do so?

  • Navigate to regsol.be and log in using your e-mail address and password
  • Click on your name in the top right corner
  • Go to “User management” 
  • Click the blue “Change” button next to your personal details
  • Click “Retrieve national register number” or “Add attorney card number”
     
  1. To add your national register number via one-off strong authentication
    You will be redirected to CSAM, where you will be asked to enter your PIN code
  2. To add your attorney card number via one-off strong authentication
    You will be redirected to Zetes, where you will be asked to enter your PIN code
  • Once your national register number/attorney card number has been added, a green tick will be displayed next to your national register number/attorney card number
  • Once complete, you will need to log out and log back in using your eID, Itsme or attorney card.
     

You will be able to do the following in RegSol if you log in using strong authentication:

As the identity of the applicant is very important for certain actions, you will only be able to perform these actions following strong authentication from 18/11/2019. 

The regsol.be actions in question are as follows:

For bankruptcies:

  • Filing (or preparing) a declaration of bankruptcy, as the debtor or as an adviser of the debtor
  • Adding an article to the timeline of an ongoing bankruptcy case, as the debtor or as an adviser of the debtor
     

For Judicial Reorganisation Procedures:

  • Filing (or preparing) a request for a Judicial Reorganisation Procedure, as the debtor or as an adviser of the debtor
  • Performing actions under the “DEBT CLAIMS” tab, as the debtor or as an adviser of the debtor
  • Adding a document/article to the TIMELINE of an ongoing case, as the debtor or as an advisor of the debtor
  • Filing a request for voluntary intervention, as a third party or as an advisor of a third party
  • Filing a request to dispute or include a debt claim, as a creditor or as an advisor of a creditor
     

For extra-judicial amicable settlements:

  • Filing a new case

Some of the actions you can perform after logging in with your eID will remain available after logging in with just your e-mail address and password. 

The following regsol.be actions can still be performed without strong authentication:

  • Searching for an ongoing case (bankruptcy or Judicial Reorganisation Procedure) and viewing the basic details of the case.
  • Requesting access to a case.
  • Viewing a case to which you already have access. 
  • For bankruptcies: preparing, filing or amending a debt claim declaration 
  • For Judicial Reorganisation Procedures:  filing a debt claim to interrupt a limitation period 

 

To increase the level of security in relation to user identities, strong authentication will be required from 18/11/2019 for certain actions when using regsol.be. 

By logging in with your attorney card you will be able to perform an action on regsol.be that requires this strong authentication.

You can log in using your attoreny card once your attorneycard number has been added to your account via one-off strong authentication.
 

What is the one-off process to do so?

  1. Navigate to regsol.be and log in using your e-mail address and password
  2. Click on your name in the top right corner
  3. Go to “User management” 
  4. Click the blue “Change” button next to your personal details
  5. Click  “Add attorney card number”

You will be redirected to Zetes, where you will be asked to enter your PIN code

  1. Once your attorney card number has been added, a green tick will be displayed next to your attorney card number
  2. Once the login process has been completed, you will be taken back to your personal profile on RegSol. Please note: the strong authentication process is not yet complete at this stage!
  3. Log out of www.regsol.be using the “Log out” function located underneath the arrow next to your e-mail address in the top right corner. You will be taken back to the RegSol login screen.
  4. Select the “Log in attoreny card” option. Connect the card reader, insert your attoreny card and follow the instructions.
  5. At this point, you will be logged in with strong authentication.

For subsequent visits to RegSol, you will only need to follow steps 9 and 10 to ensure you are logged in with strong authentication every time.
 

You will need to log in with your eID to ensure strong authentication, meaning you will need to use a card reader to read your card. In concrete terms, this is done as follows:

Step 1:
Go to www.regsol.be and log in using your current e-mail address and password.

Important: 
if you have previously logged in using your electronic identity card, you can continue to use the “Log in with eID” option on your first visit after 18/11/2019 instead of logging in with your e-mail address and password. 
However, you will NOT have completed the strong authentication process until you have followed steps 2 to 8 below. As long as no extra validation has taken place of the national register number on your profile, you will remain weakly authenticated.

Step 2:
Go to “User management” on regsol.be and locate your personal details. Click the “Change” button. 
Please note: if you have previously logged in using your electronic identity card, your national register number will already be displayed. However, you will still need to complete the following steps as a one-off to confirm your national register number is correct.

Step 3:
Click the “Retrieve national register number” button next to the “National register number” field.

Step 4:
This action will take you to the login portal of the Belgian government. 
Select one of the login options provided (eID or itsme). Next, follow the steps required to complete the login process (e.g. enter your PIN code if you have chosen to log in using eID).

Please note:
If this screen is displayed during the login process, please contact CSAM or reinstall the eID software on your computer as shown in the message on screen. The RegSol helpdesk cannot assist you with CSAM-related issues.

Step 5:
Once the login process has been completed, you will be taken back to your personal profile on RegSol. Verify whether your national register number has been filled in correctly. Please note: the strong authentication process is not yet complete at this stage!

Step 6:
Log out of www.regsol.be using the “Log out” function located underneath the arrow next to your e-mail address in the top right corner. You will be taken back to the RegSol login screen.

Step 7:
Select the “Log in via eID” option. You will be taken back to the Belgian government portal and can log in again using one of the methods provided (eID or itsme).

Step 8:
Once this login process has been completed (for the second time), you will be taken back to RegSol. At this point, you will be logged in with strong authentication.
For subsequent visits to RegSol, you will only need to follow steps 7 and 8 to ensure you are logged in with strong authentication every time.


Please note
Even if you have previously logged in to regsol.be using your eID, you will need to have your eID card read by a card reader after 18/11/2019. You will then be able to log in using your eID.

Strong authentication can only be performed on the basis of a Belgian national register number or BIS number. 
If you do not have these numbers and would still like to perform an action on regsol.be that requires strong authentication, it is best to contact a Belgian attorney who can perform these actions for you.

Follow up/edit a dept claim

You can only consult the qualification (held, accepted or disputed) of your debt claim in the Review Statement. You will receive a notification when the Review Statement has been uploaded to the file. You can find the Review Statement under the 'Timeline' tab in the file's detail.

Your debt claim was probably uploaded between the time the bankruptcy curator generated the Review Statement and the time the registry validated the Review Statement. Your debt claim will be included in the next Review Statement.

By clicking on this black “plus” button you can consult the composition of the amounts of the debt claim per lien, as submitted by the creditor or their authorised agent.

General questions

The e-mail lets you know that specific information is ready for you in RegSol.  However, e-mail is not a sufficiently secure platform to exchange confidential information.  As such, you will be asked to click a link that will take you RegSol, where you can view the full message in a secure environment. One additional benefit is that the message will remain stored on RegSol, meaning you can view it at any time.

Are you a creditor's authorised agent?


As a lawyer, accountant, agent or other authorised agent, you can submit a debt claim on behalf of the creditor. As a third party who provides professional support, you are obliged to submit this debt claim digitally

  • Go to regsol.be and log in.
  • Find the desired file via the 'Search for files' tab
  • Click on the file to open it
  • You can submit a debt claim via the 'General information' tab
     

In order to submit your debt claim digitally, you will need:

  • all details relating to the debt claim (name and address, amounts, supporting documents such as invoices or contracts)
  • your personal details as a creditor (included in your account – see FAQ “Dow do I access RegSol Public” if you don't have an account yet) 
  • the account number for the payment of any dividends.

Proceed as follows: 

  • Go to regsol.be and log in.
  • Find the desired file via the 'Search for files' tab
  • Click on the file to open it
  • You can submit a debt claim as the creditor or authorised agent via the 'General information' tab

Important: for security reasons, the application will close automatically after 60 minutes of inactivity. You can always 'temporarily save' the entered data so that you can retrieve it the next time you log in.
 
Your digital debt claim is only final and valid after you have validated the data by checking the entries at the bottom of the overview (with regard to accuracy and completeness).
You will receive a message on the screen informing you that your debt claim has been submitted. After submission, you will find the debt claim under the 'My debt claims' tab.
 

  • Go to regsol.be and sign up (you must first create an account on regsol.be if you don't already have one)
  • Find the desired file via the 'Search for files' tab
  • Click on the file to open it
  • You can submit a debt claim as the creditor via the 'General information' tab

Go to regsol.be and log in.

  • You can look up a debt claim that has been submitted by your group using the 'My debt claims' button. Use the search filters and click on the blue 'Search' button to do a specific search.
  • Alternatively, you can also first search for the file in question using the 'Find files' button or the 'My files' button and then click on the 'Debt claims' tab in the detail of the file.

For each file for which you have submitted a debt claim, you have access to

  • the file's general information under the 'General information' tab;
  • the debt claims declarations in the file, limited to names and amounts
  • 'My added items' which displays the items uploaded by your group in the timeline.
  • the items (declarations, documents, judgements, official reports, etc.) that belong to the file and for which you have access rights – under the 'Timeline' tab.

    For example, you can consult:   
    • the bankruptcy order,
    • the judgment determining the time of cessation of payments;
    • the petitions of the curator
    • he decisions of the examining magistrate;
    • the site inspection report;
    • the inventory report;
    • the debt claim declarations, limited to names and amounts;
    • the debt claims Review Statement;
    • the list of settlements and approvals;
    • the reports and distribution lists drawn up by the curators;
    • the simplified account.

 

Your access rights are governed, with regard to old bankruptcies prior to 1 May 2018, by the Bankruptcy Act of 8 August 1997, and thereafter by Book XX Insolvency of Companies, and its implementing decrees.

Please note: your submitted debt claims can be found under the 'Debt claims' tab and not in 'My added items'. In the 'My added items' tab you can consult the documents uploaded by your own group before they have been processed by the different actors.

Please note: with regard to bankruptcy files, you can only consult the documents being processed by the court after they have been dealt with by the various actors (curator, examining magistrate, registry) and have been finalised by the registry.

  • Go to regsol.be and log in.
  • Search for your debt claim using the 'My debts claims' button or via the 'Debt Claims' tab in the detail of a specific file.
  • In the debt claim in question, go to the last 'Action' column and click on 'Change your debt claim'.

  • You arrive at a page that contains a brief overview of your debt claim.
  • At the top right, click again on 'Change debt claim'.

  • You arrive at a page where you can edit your debt claim.
    In the 'Composition of the amounts' box you can change the amounts and add extra lines with new amounts according to other liens, as long as the curator has not yet processed all lines of your debt claim. If the line of the claim has been provisionally filed, you can still change the amount filed for that line.   If the curator has already processed certain parts of your debt claim, you will no longer be able to change all the fields. These fields will then be coloured in grey and     no longer be editable.
  • After you have made the desired edits, click on 'Change debt claim' at the bottom right to save your changes.

     

Go to regsol.be and log in.

Look up your debt claim:

  • via the button 'My debt claims'
  • or via the buttons 'Search for file' or 'My files' and then click on the 'Debt claims' tab in the detail of the file.
     

In the results list, you can view the 'Status' of your debt claim in the 2nd column:

  • To be submitted: you have an unsubmitted draft of a debt claim for this file
  • Submitted: you have a debt claim in this file. The curator has yet to process this.
  • In progress: the bankruptcy curator is processing your debt claim, you can no longer change certain lines.
  • Qualified: your debt claim has been qualified, view the Review Statement in the timeline.
  • Rejected: Your debt claim has been rejected by the curator. You can find the reason for rejection in your notifications on the homepage.
  • Withdrawn: you have withdrawn this debt claim from this file. In the 'Actions' column you will find the actions that you can perform.
     

Please note: you can only consult the qualification (held, accepted or disputed) of your debt claim in the Review Statement. You will receive a notification when the Review Statement has been uploaded to the file. You can find the Review Statement under the 'Timeline' tab in the file's detail.

The qualification (held, accepted or disputed) that the bankruptcy curator has given to your debt claim can only be consulted in the Review Statement. 

For files that fall under the application of Book XX, the first Review Statement is drawn up approximately two months after the bankruptcy file is opened. A second Review Statement follows six months after the date of the bankruptcy, and a third and final Review Statement after one year.

You will receive a notification when the Review Statement has been uploaded to the file. You can find the Review Statement under the 'Timeline' tab in the file's detail.
 

You can consult the reason for rejection:

  • in the Review Statement (if you still have access to the file in another capacity)
  • in your notifications on the homepage of regsol.be

You can only view the PDF and attachments of a debt claim:

  • if you are a debtor or lawyer of the debtor for a file
  • if you hold a special capacity for which the law stipulates that you have access to certain information
  • if it concerns a debt claim that you or another user of your group has submitted

Proceed as follows:

  • Go to regsol.be and log in.
  • Find the file in question via the 'Search for files' or 'My files' tab and open the 'Debt claims' tab  
     

Alternative: click on the 'My debts' button on the regsol.be homepage and select the desired debt

  • The overview list of debt claims opens.
  • Click on the icons below in the last column, 'Actions', to download the PDF of the submission and the attachments to the debt claims.

If these icons are missing from the 'Actions' column then there are no attachments to consult.

You can continue to edit a provisionally filed (line in a) claim. The curator will be notified if you adjust the provisionally submitted amount after the curator has already edited this line. Once you have definitively budgeted the amount, please untick the "provisional" box.

Please note that the curator will make a final decision on your claim in the 3rd Review of Insolvency of your claim. Adjustments after the 3rd Review of Insolvency are not possible.
 

Debt claim in an open file
If you wish to change your debt claim, you will notice that certain fields are coloured dark grey and that, in some cases, the 'Composition of the amounts' box is also missing the 'plus button' that usually allows you to add an extra amount to the debt claim.

Composition of the amounts
In 'Composition of the amounts', you can only amend lines of your debt claim that the curator has not yet processed. 

If you have entered the amount of your claim provisionally, you can still adjust it for this line.
But once the curator has edited all the lines in your claim with the final amounts, you cannot make any changes in the framework "composition of the amounts".

If the bankruptcy curator has processed all lines in your debt claim, you can no longer amend anything in 'Composition of the amounts'. You will therefore not be able to add extra lines with extra amounts to your debt claim.

You can only consult the decision of the bankruptcy curator in the Review Statement. You can find the Review Statement in the file's 'Timeline' tab. You will receive a notification when the Review Statement is uploaded.

  • If you still wish to change the amount of a debt claim, even if this is no longer possible via regsol.be, you will have to contact the bankruptcy curator.
  • If you only wish to add an amount to your debt claim, you can submit a new debt claim for this in the file.

Debt claim in a closed file
You can no longer edit your debt claim in a closed file. You will find fewer icons in the 'Actions' column than are shown for an open debt claim file

No. You can no longer edit your debt claim in a closed file. 

  • In the detail of the debt claim, the button 'Change debt claim' will no longer appear.
  • In the detail of the debt claim, in the top left next to the name of the file you will find a red mark labelled 'Closed'.
  • You can no longer transfer your debt claim in a closed file.
  • You can no longer withdraw your debt claim in a closed file.

You can transfer your debt claim to another creditor, to someone else in your group or to someone else in your account, provided that the transferee has an account on regsol.be.

  • Go to regsol.be and log in.
  • Find the debt claim you wish to transfer.
  • In your list of debt claims, click on the double arrow (= transfer) in the 'Actions' column.

  • Select to whom you wish to transfer the debt claim from the drop-down menu and complete the required details.

  • Select the correct group and user and click on 'Transfer'
    • After transfer, the debt claim will be visible to the new creditor/in the new group to all users within that group
      After transfer, the email address on the debt claim (visible to the curator) will be the email address you select from the drop-down.
  • The debt claim no longer appears in your 'My debt claims' list after transfer.

Please note: you can also transfer a debt claim to a colleague within your own group. In practice, however, this only changes the email address that appears on the debt claim for the curator. You will still find this debt claim in the 'My debt claims' list as this list contains the debt claims submitted by all of your group's users.

You can transfer a batch of debt claims to another party.

You can transfer a single debt claim, but you can also transfer several debt claims in one operation.  

The conditions to transfer multiple debt claims in bulk are:

  • the group to which you transfer the debt claim already has an account on regsol.be
  • the selected debt claims must have the 'Transfer' action button

Proceed as follows:

  • Go to regsol.be and log in.
  • Click on the 'My debt claims' button
  • In the list, indicate all the debt claims that you wish to transfer. To do this, tick the checkbox in front of the debt claim. The selected debt claim turns blue.
  • Click the 'Bulk transfer' button at the top right of the results list.

  • Select to whom you wish to transfer the batch of debt claims 

If you wish to transfer debt claims in bulk within your own accounts:

  • Select 'To a colleague' from the drop-down menu.
  • Select the correct group and the correct user
  • Click on 'Transfer'.
     

If you wish to transfer debt claims to a new creditor or an authorised agent outside of your account:

  • Select 'To a creditor or an authorised agent' from the drop-down menu
  • Enter the recipient's company number or national register number
  • Select the desired group
  • Click on 'Transfer'
     

If the desired group is not selectable: contact the person to whom you wish to transfer the debt claims and ask them to create an account on regsol.be.

A submitted debt claim cannot be deleted. 
If you no longer wish to maintain the submitted debt claim, you can withdraw it using the 'Withdraw' button in the 'Action' column in the list of debt claims:

Please note: if you withdraw a debt claim, you will no longer have access to the file as a creditor. If you still wish to follow the file, you must request access as a third party.

If the bankruptcy curator has prepared a tax certificate for a debt claim, you will receive a notification of this. Notifications can be found on the homepage under the title 'Notifications' or in the file's detail under the 'Notifications' button. 
If you wish, you can receive an e-mail from these notifications, insofar as you set this in your user settings as follows:

  • click on your email address at the top right
  • click on 'User settings'
  • Place a green checkmark next to 'Receive notifications by mail?'

 

  • Sign up at regsol.be
  • Go to the file in question via the 'My files' tab.
  • Open the 'Debt claims' tab
  • You can then download the tax certificate by clicking the action button in the penultimate column 'Tax certificate'.

First of all, you must indicate that you wish to use the List of Creditors module in RegSol. You will then see the Creditors module under the Debt Claims tab in the detail of your dossier. 


Next, choose which type of creditor you wish to add (a natural person, a legal entity or natural person with a company number or a foreign legal entity) 

  • Enter the details of your creditor  
  • Create categories of debt claims 
  • Fill in the details and add files 
  • Click "save" on the bottom right 

 
Important: If you are applying for a Collective Agreement, the use of the RegSolList of Creditors module is an absolute prerequisite for: 

  • any subsequent electronic vote on the reorganisation plan 
  • the creation of letters via RegSol that you will send to the debtor after the proceedings commence, whereby the creditor will immediately be issued with a unique code that they will need to register in the dossier. 

Full use of the list of creditors module will enable you to handle more tasks via RegSol, such as:  

  • consulting creditors and their claims 
  • amending debt claims 
  • adding creditors and their claim (via Excel import or otherwise) 
  • depositing an amended list of creditors in the dossier at any time via the "Add list of creditors to timeline" function on the bottom left. 

 
Once the court grants the proceedings, you can ...: 

  • link users who can access the dossier to the correct claim. This will allow them to vote electronically in the dossier at a later date. 
  • generate mandatory notifications via the blue 'Generate Letter' button in the Notification column. 

 
Creditors who connect to the notification of their claim via the QR code can cast their vote electronically in the dossier at a later date. 
 

  • Once proceedings have been granted, you can generate notifications via the Creditors module. 
  • Letters generated in this manner will contain a strictly personalised QR code for the creditor
  • Send the letter to the creditor by post or email. 
  • The creditor can then access the dossier via this QR code. 
  • Creditors will only be able to cast their vote on the reorganisation plan electronically in the event of a Collective Agreement if they are linked to their claim. 

Creditors linked to their claim (either through their QR code or directly through you in the Creditors list after they have requested access to the dossier without a QR code) will be able to cast their vote on the reorganisation plan electronically if they so wish. 

The linked creditors will also receive electronic notification from the correctional court registry regarding the filing of the reorganisation plan via RegSol.

You want to submit a time-barred debt claim as part of a file to which you do not yet have access?

 

To file a time-barred debt claim in a JRP to which you do not yet have access, you first need to find the file in question. To do this, you must first click the 'Search for files' tab in the header.
 
There are various fields that allow you to find a file:

  • Name of the enterprise
  • Company number
  • Post code/place
  • Type of proceeding
     

By default, the system searches the bankruptcy files. To find a file in JRP, you have to change the type of 'proceeding' at the bottom of the menu.
 

After finding the file in JRP for which you wish to submit a time-barred debt claim, click on the option 'Upload debt claim'.

You will then find your submitted time-barred debt claim in the 'My added items' tab in the file. 

 

Do you wish to submit a time-barred debt claim in a file to which you already have access?

 

Go to the 'My files' tab to find the file in question. Click the 'Upload debt claim option.  
You will then find your submitted time-barred debt claim in the 'My added items' tab in the file.

Please note: submitting a time-barred declaration does not affect the composition of the list of creditors in the JRP.

Unlike bankruptcy files where you automatically have access to the file as a creditor once you have submitted a debt claim, when it comes to a JRP you must submit a separate request for access to the file. This is therefore independent of the possibility of submitting a time-barred debt claim.
