If you are a creditor or debtor and you have a legal counsel who has access to your file or debt claim, you will see exactly the same documents as your legal counsel.

You can also add documents to a bankruptcy file yourself, although the actions you can take are limited. In judicial reorganisation proceedings, you cannot add documents yourself if your file is managed by an attorney.

In the event of judicial reorganisation proceedings:

  • Either your first solicitor can add you as debtor because you want to follow up the file yourself; then you can remove the solicitor and/or add a new solicitor.
  • Or a new solicitor can request access to the file: the delegated judge can grant the access and cancel the access of the first solicitor.
     

In case of bankruptcy:

  • Either a new solicitor requests access to the file: the examining magistrate can approve this application for access and cancel the access for the first solicitor.
  • In other words, if you wish to follow up your file or debt claims yourself, you can request access from the examining magistrate yourself.
